Takedown Policy

Introduction


This Takedown Policy ("Policy") outlines the procedures and guidelines for the removal of infringing content from Essal's website, online platforms, and any other digital properties ("Platforms"). Essal is committed to protecting intellectual property rights and ensuring compliance with applicable laws and regulations. This Policy aims to provide a streamlined process to promptly address and remove any content that infringes upon the rights of others.


Reporting Infringing Content


If you believe that any content on Essal's Platforms infringes upon your intellectual property rights or violates any applicable laws, please submit a formal notice of infringement ("Notice") to our designated agent. The Notice should include the following information:


1. Identification of the copyrighted work or other intellectual property claimed to have been infringed;


2. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled;


3. Sufficient information to permit Essal to locate the material on the Platforms;


4. Your contact information, including your full name, address, telephone number, and email address;


5. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and


6. A statement that the information in the Notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Review and Removal Process


Upon receipt of a valid Notice, Essal will promptly review the information provided and take appropriate action. This may include removing or disabling access to the infringing material within a reasonable timeframe.


Counter-Notice


If you believe that your content has been wrongly removed or disabled as a result of a Notice, you may submit a counter-notice ("Counter-Notice") to Essal's designated agent. The Counter-Notice should include the following information:


1. Identification of the material that has been removed or to which access has been disabled;


2. Your contact information, including your full name, address, telephone number, and email address;


3. A statement that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;


4. A statement consenting to the jurisdiction of the Algerian courts and that you will accept service of process from the person who provided the original Notice or an agent of such person; and


5. Your physical or electronic signature.


Upon receipt of a valid Counter-Notice, Essal will review the information provided and may reinstate the removed material within a reasonable timeframe unless the original complainant files a legal action seeking a court order to restrain the alleged infringer.


General Information


1. Essal reserves the right to modify or update this Policy at any time without prior notice. It is your responsibility to review this Policy periodically to ensure compliance.


2. Essal may, at its sole discretion, take appropriate legal action against individuals who knowingly submit false or misleading Notices or Counter-Notices.


3. This Policy is governed by the laws of Algeria, and any disputes arising out of or in connection with this Policy shall be subject to the exclusive jurisdiction of the Algerian courts.
